Change of management for Bexley Park Residents

A letter with a copy of the Preliminary Notice sent to First Port by Jobsons Solicitors working on behalf of BPRA was recently sent to all freehold residents on the development. The Preliminary Notice once served to First Port allows BPRA to apply at a First Tier Tribunal ( FTT) for a change of management. Those freehold properties that fall under Old Bexley Lane Ltd are excluded from this process and their management will remain unchanged.

Our application is unique as it seeks the appointment of a manager for both freehold and leasehold estate.  As such, we are legally required to serve the Preliminary Notice(Notice) on the Freeholder of the leasehold property before we can make the application to the FTT.  However, as the estate also comprises of a vast amount of freehold property, our solicitors have been advised by their counsel that Notice should be served on each freeholder of the estate. Failure to do so could leave our solicitors open to criticism at Tribunal.

We were able to clarify with our solicitors whether there had been any data breaches with the attached list of names and addresses sent to all residents. They were able to assure us that this was not the case as all information had been provided by owners and is publicly available online. This information also forms part of the application to the FTT and has to be included in the Preliminary Notice.  It also demonstrates that there is strong support for the change in management of the development. Only the participants who were in favour of the change in management were included in the list attached to the Notice.
